1. Introduction
1.1. These terms and conditions ("Terms") govern the use of Kiko Art ("the Shop") and the purchase of products from the Shop.
1.2. By accessing and using the Shop, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Shop.

3. Products
3.1. The Shop offers a range of candles, home fragrance products, and art products.
3.2. Product descriptions, prices, and availability are subject to change without notice.
4. Orders and Payments
4.1. To place an order, customers must provide accurate and complete information.
4.2. Payment for orders must be made using the payment methods available on the Shop’s website.
4.3. All prices are listed in GBP (£) and include applicable taxes, unless stated otherwise.
5. Shipping and Delivery
5.1. The Shop will make reasonable efforts to deliver products in a timely manner but is not responsible for delays caused by factors beyond its control.
5.2. Shipping fees and estimated delivery times are provided during the checkout process.
5.3. Delivery typically occurs within 5 working days after your order is processed. If your order has not arrived within 10 working days, please contact us.
5.4. While we strive to meet delivery estimates, delivery dates are not guaranteed. Delays of 14 days or less do not entitle you to reject the order or claim compensation.
5.5. Shortages or defects must be reported in writing within 7 working days of receipt of goods.
5.6. In the event of delivery failure caused by the Shop’s fault, the Shop’s liability will be limited to the replacement of goods or refund of the original purchase price.
5.7. You may return goods within 14 working days of delivery, at your expense unless the items received were incorrect or faulty. Goods must be returned in their original condition, and you will receive a refund within 30 days of our receiving the returned goods. This right does not apply to personalized or custom items.
6. Risk of Loss
6.1. Risk of loss or damage passes to you once the goods leave the Shop's premises or are collected by an authorized carrier.
6.2. You are responsible for insuring the goods from the time risk passes to you.
7. Unforeseen Delay
Neither party will be held liable for any delay or failure to perform due to causes beyond its reasonable control.
8. Intellectual Property
8.1. All content on the Shop’s website, including text, images, logos, and product designs, is the intellectual property of Kiko Art and may not be used without permission.
9. Local Taxes
9.1. The customer is responsible for any import duties, VAT, or other local taxes imposed by their country on the purchase of goods.
9.2. If any taxes increase the seller’s costs, the Shop reserves the right to adjust the product price accordingly.
10. Warranties & Liability
10.1. The Shop warrants that goods will match their description and be free of material defects.
10.2. The Shop is not responsible for defects caused by misuse, negligence, or failure to follow instructions.
10.3. You must notify the Shop of any defects within 7 working days of receiving the goods, or within a reasonable time if the defect was not initially apparent. The Shop may replace defective goods or refund the purchase price at its discretion.
10.4. The Shop is not liable for indirect or consequential losses, including loss of profit, goodwill, or business, unless caused by negligence.
11. Retention of Title
11.1. Ownership of the goods remains with the Shop until full payment is received.
12. Your Use of the Goods
12.1. You are responsible for instructing users of the products on their safe use, especially if the product comes with safety instructions. Failure to comply may void any claims for injury or damage, and the Shop will not be liable.
13. Insolvency of Buyer
13.1. If you become insolvent or bankrupt, the Shop has the right to cancel or suspend further deliveries and demand immediate payment of outstanding orders.
14. Governing Law
14.1. These Terms are governed by English Law, and any disputes will be resolved exclusively in the courts of England and Wales.
15. Discounts, Promotions & Sale Items
15.1. Discount codes must be applied at checkout and cannot be added after the order is processed. Once an order is shipped, no discount codes can be retroactively applied.
15.2. Discounts or promotions cannot be applied to orders placed prior to the announcement of the promotion or sale. Discounts cannot be applied to sale items or combined with other promotions unless stated.
15.3. Postage costs do not count towards the basket total for minimum purchase discounts.
